The offer and sale of products made on this site website www.tuchic.it are governed by these General Conditions of Sale.

The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale as sending the purchase order implies full knowledge and express acceptance of both the aforementioned general conditions of sale than what is indicated in the Order Form.
Once the online purchase procedure has been completed, the Customer must print and keep these general conditions of sale and the relative order form, which have already been viewed and accepted.
The offer and sale of products made on site www.tuchic.it this website are governed by these Terms of Sale.

ART. 1 Object/OBJECT
1.1 These General Conditions of Sale concern the sale of products made online through the electronic commerce service on the site www.tuchic.it
Products whose main characteristics and prices have been indicated on the site itself (including any additional costs).
1.2 The products sold on the site can only be purchased and delivered in the countries indicated in the Order Form. Any orders for shipments to be made outside these countries will be automatically rejected during the order processing procedure.

2.2 These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on the website www.tuchic.it and do not, however, govern the supply of services or the sale of products by subjects other than the Seller who are present on www.tuchic.it via links, banners or other hyperlinks. Before placing orders and purchasing products and services from parties other than the Seller, the Customer is invited to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller.
2.3 The products are sold to the Customer identified by the data entered when completing and sending the order form in electronic format with the simultaneous acceptance of these General Conditions of Sale.
2.4 The product offers on the site www.tuchic.it are aimed at adult customers.
If the Customer is under the age of 18, in order to purchase on the site www.tuchic.it he must first obtain the consent of one of the parents or legal guardian .
Therefore, the Customer who places an order on this website automatically guarantees that he is of legal age (18 years old) and has the legal capacity to enter into binding contracts.
2.5 The Customer is prohibited from entering false, and/or invented, and/or fictitious names in the online order procedure and in further communications. The Seller reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers.
2.6 By accepting these Conditions of Sale, the customer expressly exonerates the Seller from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided when entering the online order, since the customer must be considered the only responsible for their correct insertion.

2.3 The products are sold to the customer identified by the data entered at the time of compilation and transmission of the electronic order form with simultaneous acceptance of these Terms of Sale.
2.4 The products offered on the site www.tuchic.it cater to older customers.
If the customer is under the age of 18 years for the purchase on www.tuchic.it site you must first obtain the consent of your parents or your legal guardian.

3.3 The Order contains:
- a reference to these General Conditions of Sale;
- information and images of each Product and its price;
- the means of payment that can be used;
- the methods of delivery of the Products purchased and the related shipping and delivery costs;
- a reference to the conditions for exercising the right of withdrawal by the Customer;
- the methods and times for returning the purchased products.
3.4 TuChic has taken measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies. Nonetheless, we inform you that some variations are always possible due to the technical characteristics and color resolution characteristics of the computer used by the Customer.
It follows that the Seller will not be held responsible for any inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since such representations must be understood as having a mere illustrative function.
3.5 Before concluding the contract, the Customer is asked to confirm that he has read the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.
3.6 The contract is concluded when the Seller receives your Order Form via the Internet, after verifying the correctness of the data relating to your order.
3.7 The language available to conclude the contract with the Seller is Italian and the applicable law is exclusively Italian.
3.8 Once the contract is concluded, the Seller will take charge of the customer's Order and will take care of its prompt evasion.
3.1 For online sales contract means a distance contract for the sale of movable property (hereinafter Products) concluded between you, as a customer, and TUCHIC srl as a Seller, as part of an e-commerce service organized by the Seller that, for this purpose, employs the distance communication technology called Internet.
3.2 To conclude the purchase of one or more products, the customer is required to fill out the electronic order form (hereinafter Order) and to transmit it to the Vendor via the Internet by following the instructions.
3.3 In the Order are contained:
- A reference to these Terms of Sale;
- Information and images of each product and its price;
- The use of payment instruments;
- The method of delivery of the purchased products and their shipping costs and delivery;
- A reference to the conditions for exercising the right of withdrawal by the Customer;
- The manner and the return of purchased products.
3.4 TuChic has taken measures to ensure that the photographs displayed on the Site are faithful reproductions of the original products, including adopting every technological solution possible to minimize inaccuracies. However, it warns that some changes are always possible because of the color resolution specifications and features that comes with your computer to the customer.
It follows that the Seller shall not be held responsible for the eventual inadequacy of the graphic representations of the products shown on the Site owing to the above mentioned technical reasons, since such representations shall be constructed as being merely illustrative purposes.
3.5 Before concluding the contract, the customer is asked to confirm that you have read the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.

ART. 4 Fulfillment of the Order

4.1 By submitting the Order, the Customer unconditionally accepts these General Conditions of Sale and therefore undertakes to observe them.
4.2 Once the contract is concluded, the Seller will send you its Order Confirmation by e-mail to the address provided by the Customer with the order.
This confirmation will contain the summary of the information already contained in the Order described in the ARTS 3.3, 3.4 and 3.5.
4.3 The Seller reserves the right to ask the Customer via e-mail or by telephone, for further information with reference to the Order sent via the Internet and this even before forwarding the relative confirmation.
4.4 The Seller may not process the Customer's purchase orders which do not give sufficient guarantees of solvency or which are incomplete or incorrect or in the event of unavailability of the products. If one of these hypotheses occurs, the Customer will be promptly informed of the failure to complete the contract by e-mail and the sum paid at the time the Order was sent will be returned to him without delay.
4.5 If the products presented on the website are no longer available or on sale after the Order has been sent, it will be the Seller's responsibility to notify promptly and in any case within fifteen (15) working days starting from the day following the in which the Customer sent the Order to the Seller, the possible unavailability of the Products ordered. In this case, the sum previously committed to the Customer's means of payment will be released.
4.6 The Seller undertakes to deliver the products ordered to the Customer within 10 working days from the date of conclusion of the contract. For orders placed by buyers, production times are 15 working days, shipping times excluded.
4.7 Each sale made by the Seller through the online sales service may concern one or more products, with no quantity limit for each item. For buyers, the minimum order is 3 pieces of the same model, same colour.
4.8 TuChic reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous order. This applies equally to all cases in which TuChic deems the customer unsuitable, including, by way of example, the case of previous violations of the contract conditions for online purchases on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activity of any kind.
4.1 Through the order transmission the customer unconditionally accepts these General Conditions of Sale and agrees, therefore, to observe them.
4.2 After the contract, the seller will send you your Order Confirmation by e-mail service to the address provided by the customer with the order.
Such confirmation will contain a summary of the information contained in the Order described in the ARTICLES 3.3, 3.4 and 3.5.
4.3 The Seller reserves the right to call the customer via e-mail or by phone, additional information with reference to the Order sent via the Internet, and this even before submitting the relevant confirmation.
4.4 The Vendor may not process purchases of customer orders that do not give sufficient guarantees of solvency or which are incomplete or incorrect, or in the event of unavailability of products. Recourse if any of these assumptions, the customer will I be informed promptly of the failure to complete the contract by e-mail and at the same will be returned, without delay, the sum paid at the time the Order.

4.8 TuChic reserves the right to reject orders from any customer with whom there is an ongoing legal dispute regarding a prior order. This applies equally to all cases in which TuChic considers the customer unsuitable, including, without limitation, the case of previous violations of conditions of contract for online purchase on the Site or for any other legitimate reason, especially if the customer He has been involved in fraudulent activity of any kind.
ART. 5 Prices on Frifingers

5.2 All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are to be considered not inclusive of any costs connected to customs duties and related taxes, which cannot be calculated in advance, if the shipment takes place in non-EU countries or in countries where current legislation provides for import charges. In this case, the existence of any additional costs indicated above will be clearly mentioned during the entry and revision of the Order, it being understood that the precise amount of these costs will be communicated by the Carrier to the Customer upon delivery of the products.
5.3 These costs therefore remain the responsibility of the Customer and must be paid directly upon delivery of the Products, according to the indications specified in the Order Confirmation.
5.1 All prices of products and shipping costs and delivery times indicated on the website and in the Order are to be considered VAT included and in Euros Unless otherwise explicitly agreed in writing,.

5.2 All products are shipped directly from Italy. Product prices and shipping costs and delivery times indicated on the website and in the Order, unless otherwise specified, are to be considered exclusive of any costs related to customs duties and related taxes, unless previously calculated, if the shipment is in non-EU countries or in countries where the applicable legislation provides for import charges. In this case the existence of any additional costs mentioned above will be clearly mentioned during insertion and revision of the Order, it being understood that the exact amount of these costs will be communicated by us to the customer upon delivery of the products.
5.3 These costs are therefore charged to the customer and to be paid directly upon delivery of the products, according to information as specified in the Order Confirmation.
ART. 6. Methods of payment
For the payment of the price of the Products and the relative shipping and delivery costs, the Customer must comply with the methods indicated in the order form of the site www.tuchic.it
At no time during the purchase procedure will TuChic be able to know the Customer's credit card information (for example, the credit card number or its expiry date), transmitted directly to the site via a secure encrypted protocol connection of the person who manages the electronic payment (bank or Paypal).
No computer archive of the Seller will keep such data.
Under no circumstances, therefore, can the Seller be held responsible for any fraudulent or illegal use of credit and prepaid cards by third parties.
ART. 7 Shipments and delivery of products
The shipment will contain the product ordered, the relative transport document/accompanying invoice and/or the necessary documentation required according to the country of shipment.
ART. 8 Right of withdrawal
8.1. Only if the Customer who stipulates the contract is a Consumer (meaning by this definition any natural person who acts on the site for purposes unrelated to any business or professional activity carried out), will he have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, communicating it to the Seller within fourteen (14) days, starting from the day on which the Customer or a third party designated by the Customer and other than the Carrier acquires physical possession of the goods. The term is considered respected if the Customer sends back the goods before the expiry of the 14-day period.
As required by current legislation, the right of withdrawal is excluded and therefore cannot be exercised if the products that the Customer has purchased have been customized at his explicit request when placing the Order.
8.2 The Customer may exercise the right of withdrawal by email sent to info@tuchic.it or fac sent to 0039+0637512243 or through the contact form on the website www.tuchic.it within the term of 14 (fourteen) days from the day of receipt of the Products
The right of withdrawal is subject to the following conditions:
a) i Prodotti resi vanno restituiti nella loro entirety and not on parts or components of them even in the case of kits;

c) i Prodotti resi devono essere restituiti nella their original packaging;

e) i Prodotti resi devono essere consegnati al courier within fourteen (14) days from the date you received the products;
If the right of withdrawal is exercised by the Customer in accordance with the previous conditions, the Seller is required to reimburse the sums paid by the customer no later than 14 days from the day on which the same was informed of the decision to exercise the right of withdrawal, condition that the Seller has already received the returned goods or that the Customer provides the Seller with proof that he has already shipped the goods.
The Seller will use the same means of payment used by the customer for the initial transaction for the re-credit, unless the latter explicitly asks the Seller to use a different means and the latter consents to it.
8.3. In the event of withdrawal, the only costs that will remain at the customer's expense will be the initial shipping costs of the order of the products purchased. All other expenses will be reimbursed by the Seller, including the costs of delivery of the returned goods following the exercise of the right of withdrawal (with the exception of the additional costs deriving from your possible choice to use a different and more expensive delivery method than the type of standard delivery offered by the Seller).
8.4 TuChic also undertakes to bear the initial shipping costs of the Products exclusively in the event of damage to the same due to transport or errors in shipping by the Seller. Only in these cases, the Seller will also reimburse the Customer for the amount paid for the initial shipping costs. The Seller will send an express courier to collect the Product from the address indicated by the Customer.
8.5 For the return, the Customer is obliged to use exclusively the Courier indicated by the Seller who will bear all costs.
8.6 In case of exercise of the right of withdrawal, the Seller will refund the corresponding amount, within 30 days from the date of receipt by the same of the returned Products according to the methods indicated above, by crediting the amount to be refunded with the same payment methods_cc781905 -5cde-3194-bb3b-136bad5cf58d_ chosen by the Customer at the time of the Order.
8.7 In the event of exercising the right of withdrawal without complying with the methods indicated above, the Seller will return the purchased Products again, also charging the Customer for the additional shipping costs.
8.9 The right of withdrawal cannot be applied in the case of personalized products at the explicit request of the Customer when placing the Order.
ART. 9. Guarantee of non-conforming products
9.1 The Seller is responsible for any defect in the products offered on the site, including the non-compliance of the articles with the products ordered, in accordance with the provisions of Italian legislation.
9.2 If the Customer has entered into the contract as a Consumer (meaning by this definition any natural person who acts on the site for purposes unrelated to any business or professional activity carried out), this guarantee is valid provided that both conditions are met indicated below:
a) the defect occurs within 24 months from the date of delivery of the products;
b) the Customer submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the latter;
c) a formal complaint is made by e-mail, fax or the contact form on the site.
9.3 In particular, in the event of non-compliance, the Customer who has entered into the contract as a Consumer will have the right to obtain the restoration of conformity of the products without charge, by means of repair or replacement, or to obtain an appropriate price reduction or the termination of the contract relating to the disputed goods and the consequent refund of the price.
9.4 All return costs for defective products will be borne by the Seller.

ART. 11. Customer Communications
The Customer acknowledges, accepts and gives his consent to the fact that all communications, notifications, attestations, information, reports and in any case any documentation on the operations performed, referring to the purchase of the Products, will be sent to the e-mail address indicated at time of registration, with the possibility of downloading the information on a durable medium in the manner and within the limits established by the Site.
ART. 12. Privacy
The Customer will be able to obtain information on how TuChic processes his personal data by logging into the Privacy Policy.
ART 13. Applicable law, dispute resolution and competent court
These General Conditions of Sale are governed by Italian law and will be interpreted on the basis of it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the Customer. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law and any disputes relating to and/or consequent to them must be resolved exclusively by the Italian jurisdictional authority. In particular, if the Customer qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same on the basis of the applicable law or, at the choice of the consumer in the event of an action taken by the consumer himself, by the Court From Rome. If the Customer instead acts in the exercise of his business, commercial, craft or professional activity, the parties consensually establish the exclusive jurisdiction of the Court of Rome.
ART. 14 Modification and update

Therefore, the Customer will be required to accept only the General Conditions of Sale in force at the time of the relative purchase. The new General Conditions of Sale will be effective from the date of publication on the website www.tuchic.it ed in relation to purchase orders submitted after that date.
